1. Acceptance of Terms

By engaging Tracepoint Intelligence (“Tracepoint”) for investigative or related professional services, the Client acknowledges and agrees to these Terms of Service, as well as any applicable Engagement Agreement, Master Service Agreement, or Work Order (SOW).

2. Lawful and Ethical Use

Tracepoint provides investigative, research, OSINT, analysis, and reporting services for lawful, ethical, and legitimate purposes only. The Client agrees that Deliverables will not be used for harassment, retaliation, defamation, discrimination, unlawful surveillance, or any improper purpose.

3. No Legal Advice / No Guaranteed Outcomes

Tracepoint is not a law firm and does not provide legal advice. Investigative outcomes are not guaranteed and may be affected by information availability, legal limitations, digital conditions, timing, and third-party actions.

4. Client Responsibilities

The Client agrees to:

  1. Provide accurate and truthful information;

  2. Confirm they have lawful authority to request the investigation;

  3. Use Deliverables only for lawful internal or legal purposes;

  4. Not misuse information or direct Tracepoint to act unlawfully.

5. Professional Conduct & Right to Disengage

Tracepoint maintains a respectful, professional working environment and may refuse, suspend, or terminate services if a Client:

  • becomes abusive, threatening, or hostile,

  • attempts to coerce unlawful or unethical conduct, or

  • misuses investigative work for personal harassment, infidelity disputes, or domestic conflict.

Tracepoint is not obligated to continue or accept work under such conditions.

6. Minors & Restricted Matters

Tracepoint does not perform surveillance or investigative work involving minors unless lawful authority (e.g., court order or direction from licensed counsel) is provided. Tracepoint does not accept harassment, stalking, or infidelity surveillance requests.

7. Confidentiality & Data Protection

Tracepoint will safeguard personal information in compliance with PIPEDA and applicable privacy laws. Data will be stored securely and retained only as required for lawful business or compliance purposes. Full privacy details are outlined in the Tracepoint Privacy Policy.

8. Fees, Retainers & Billing

Fees, retainers, expenses, and payment timelines are defined in the Engagement Agreement or Work Order. Deliverables remain the intellectual property of Tracepoint until fees are paid in full.

9. Limitation of Liability

To the fullest extent permitted by law, Tracepoint is not liable for indirect, incidental, or consequential damages. Any direct liability is limited to the total fees paid for the relevant engagement.

10. Governing Law

These Terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. The Client agrees to the exclusive jurisdiction of Alberta courts.

11. Revisions

Tracepoint may update these Terms from time to time. The version posted or provided at engagement will apply to that specific assignment.
